The most common mistake students make on this specific question is failing to adequately 'discuss both views' by either presenting them too briefly or allowing personal bias to dominate one of the body paragraphs. To avoid this, consciously allocate roughly equal paragraph length and depth to each perspective, using neutral language when explaining the view you don't personally agree with, before clearly stating your own nuanced opinion in the conclusion.

For example, after discussing fixed punishments, you could begin the next paragraph with 'Conversely,' 'On the other hand,' or 'However, proponents of a more flexible approach contend that...' This signals to the examiner that you are shifting to the opposing perspective, enhancing coherence and cohesion.
